My date will be current from September 1st. Is it okay to travel to India on a short trip while the date is current? If 485 gets approved while I am india, can I still come back on advance parole?

Hi all IV gurus,
My wife and I filed our I-485, EAD and AP on July 12th and the package arrived in NSC on July 13th. We have received all receipts and finished our FP about 10 days ago. I checked the online status and there are NO LUDs on any of our applications. All of them still show the ND of August 15th. I am EB3 ROW with PD Jan07. My I-140 is still pending at NSC.
My wife is currently on H-4 and she would like to work. Is she able to apply for a temporary EAD on October 15th, since it will already be 90 days since RD? If yes, how do we go about doing that?
Your experience and advice are very much appreciated!

I am in NYC. My wife's attorney Stephen Perlitsh, is just too busy to give us some career guidance and cancels our appointments in last moment. I have no problem paying a good fee if I can get a real good prefessional advice, it is very essential for us in this retrogressed scenerio.

5. Eliminate the one year bar on asylum claims.
How about clearing the backlogs in the employment based system? We are contributing to the wealth of the company and the economy but our futures are in limbo and the best years of our careers are wasted worrying about a green card!
Not surprisingly, according to the most recent State Department Visa bulletin, the EB-1 category is one of the only employment-based category without a waiting list.
Does that not indicate a problem that needs to be fixed instead of ignored as you have done Philip Wolgin?

I'm going to Canada on vacation for 2 days. I've read that if yr I-94 is valid and even if yr visa is expired you can return to US (thru automcatic revalidation)

My question is if you surrender yr I-94 to a Canadian inspector while crossing in to Canada, what do you show US immigration people while coming back? Do they stamp something etc? Has anyone gone thru this or knows abt this?

H1B Renewal Process is Very Simple.
But the Beneficiary cannot do it on his own.
It has to be done by your Employer since on I-129
he has to Provide lot of confidential Information about the company

You need the reference. Go to the solution window (located on the right side and right click on it and select add reference). Empty project is just that, empty.
Console applications are normally the non-GUI projects. It will default and add certain references.
Just for some future information you can create class library for creating a dll with a project. Useful if you are using certain code in multiple solutions. In this way instead of including the files you just include the project and in the solution put a reference to the project and it includes the .dll (dynamic link library) file when building the solution.

I recently applied and got my schengen visa. My case was pretty similar to yours. You should be able to use your AP document to apply for visa. They will also request you to show your travel itinerary. I do not see any problems if your return date on the travel itinerary is before your AP expiry date.

Get the DOL report before u take up the job. DOL will give the estimation for salary....!!!Use it and ask u r company attorney to file for the H1b now its self mentioning the start date as future date (when u r opt expires). Since u work for local government ...governments jobs don't come under H1b quota...so u can apply NOW.
if the DOL report comes out favorable...start the job and can look out for a better opportunity. Trust me u will find one when u have a back up job.

I am on H1B visa and my wife has filed N400. We have been married for 1 year and 2 months. she just gave her finger printing on June 10th. we have not yet filed I130 petition as of yet as we were thinking to do that after she gets her citizenship. But today I got laid off from work and the immigration officer mentioned that my wife should file I130 ASAP to avoid deportation. In form I30 On line Item 15 it says to enter the name and address of present employer. I got laid of from work on June 19 today and my wife is filing this I130 petition on Monday June 23. My termination letter indicates june 19th date. I will receive my last pay stub on July 3rd.
Should I put the name of the current employer on line 15 or should I say "unemployed" and explain in a seperate piece of paper about recent layoff? I will be out of status and will be inviting immigration if I mentioned that. Please help.
I assume your wife is not yet citizen. As a spouse og GC holder Applying I-130 does not change anything . wait until your wife gets citizenship and apply. Otherwise you have to conversion

Sent applications to NSC on 6/29 but receipted by CSC on 8/28. Later it was transfered to NSC back. No FP notice yet. But 2 LUDs on I-485, 9/19 and 9/20. EAD and AP are approved from CSC.
