Hi
I have a question regarding my spouse who is on H4 visa.One of the company did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) She is ready to work from Oct 1st as she got some project.Her employer said that they have to apply for amendment(COS) to get I94.Is this right?
2) How many weeks will it take under premium processing to get new I94
3) Do they have to apply only after Oct 1.
4) Are there any chances of getting rejected at this stage.
Can any one please suggest.

In addition there are applications that are labelled 'EXPEDITES' on receipts. These are applications where the applicant or one of the dependents is between 20 and 21 years old.

I got my GC last year... My wifes PD is the same as mine which is Sept 2003... She has been current for a while... 2 infopass and several SRs... no luck yet!

1. This Situation can be called/categorized as Aquisition/Merger?
2. Will my I140 quilified for Successor of Interest if company B is ready to take over and sponcer GC for me?
3. Or do I need to go thru the whole process of ADS, PERM, I140 path to come to current state?
4. What happens if my PDate (Old, and assuming that in either case I can port my PD??) is current before company B's I 140 got approved? Can I file I 485 based on my company A I140 As company A still exists???

Do I have give all I-94s cards on departure from US or only the one attached to the passport? Of course all are having the same number.

Hi,
I have approved I140 from company A and leaving it in few days. I will enter into 6th year in March next year.
Company B filed H1 transfer based on I140 from company A and H1 transfer is approved for three years.
Company B is little hesitant to file GC immediately due to economy but promising to file before I enter 6th year, but I am not fully sure if they do.
Can GC process be started when I am in 6th year under above circumstances? (H1 extension is NOT needed for 3 more years).
If Labor from company B gets denied during or after 6th year, can company B apply another PERM labor and pursue my GC processing?

It was my understanding that in the current context when people say "Hagel bill" they are talking about the "Hagel-Martinez" compromise on guest worker legalization, not the entire old Hagel bill.

Shouldn't the whole decision be given in 15 calender days ? My 7th year H1 ext was filed 11 days ago. No clue of a receipt number yet.

The USCIS will honor the procedure to register births or do a name change in the home country, i suggest you submit the documents that you referred to and also get a local attorney to attest to the local law in such matters citing the proper section of the law. Name change before the Court should be sufficient but better to get this verified.

Would some one post info on how to get directly to level 2 or 3 USCIS customer service rather than level 1. I Called USCIS couple of times, the customer said I need to wait 90 days to check the status with them. I filed in July and have no receipt. I would like to know whether my case is entered in USCIS database. Please guide!

no issues. My mom travelled to mumbai from chicago via frankfurt on AI. everything went well.. no issues on wheel chair as they took care of her well in transit and dropped her at the gate.
She did report issues in mumbai when she landed as it took 30 mins for wheel chair person to arrive at the gate... same AI has pathetic service in india and they are OK in US.

I want to quit my job and go back to my home country.
How long after I quit my job do I get to stay here to wrap up and ship my stuff??
Does that jeopardize my status? I plan to be here for about 30 days after quitting my job. WOuld that be ok? or is it overstaying?
If I ever need to apply for a tourist visa in future will this jeopardize my chances of getting a visa then?
