All,
I have created DIGG article for this, Please digg it.

Add this/your comment that involve the backlogged legal community already working in the USA, instead of more H1's. Thank you!

Why is Gary looking outside of USA to tap potential home buyers? Just for folks who aren't aware - there are 500,000 high skilled legal immigrant already in USA who are waiting in queue for numbers of years to get their Permanent Residency. Thanks to the limited visa availability based on country chargeability (birth of applicant) and inefficiency of immigration system, these highly skilled, tax paying and law abiding immgrants are waiting for their Green Card (Permanent residency). Some of them have studied here, worked here for years and US is almost a second home to them. They are sitting on pile of cash, Yes - PILE OF HARD CASH. They wouldn't buy house or any big ticket items until they get Green card. Why not give these people, who are already part of our system, conditional Permanent Residency who buy houses. This will also get us immediately required cash and home inventory will go down as much as 300K at minimum. P.S. I AM TALKING ABOUT HIGH SKILLED LEGAL IMMGRANTS AND NOT ABOUT ILLEGAL IMMIGRANTS.

I would suggest you go after July....Your stamping is not an issue here.....The issue will be with your I-94 when you get back into US...Since your new H1 doesnt start until July 31st, if you try to enter US in June, your new I-94 will only be valid until July 30 as the immigration officer cannot grant you entry until July 2010 based on future approval start date if its not within 15 days...My friend was in this situation before and he had to file for extension again as he only got his new I-94 valid until the date of his old I-797...

Is there any law for disabled immigrant. I am 33 years old, and I am disabled, and I am here in US from 1998. I really want to settle down in one place, and it does not matter whether it is India or America but I think I have to make a choice right now, or my future will be a big question mark.
I have waited for a long time, thinking future will be bright, day by day I dont feel I will get my Green Card, So as my lost option I am wondering whether there is any option for disable immigrant? Any help is appreciated.
thanks

Yes, you can. I have done the same. Send me a PM if you need details about that. In my case I moved from Dallas to Austin

You did not mention if you already filed your AOS application. If yes, then you may keep your application going if it's been more than 180 days since you filed.
If you have not filed I-485 then your new employer will have to start the process from beginning. You may be able to retain the old PD even if previous employer revoked the I-140, unless USCIS revoked your I-140 for fraud.
For when you already filed I-485.

(1) Determining the Priority Date.
In general, if a petition is supported by an individual labor certification issued by DOL, the priority date is the earliest date upon which the labor certification application was filed with DOL. In those cases where the aliens priority date is established by the filing of the labor certification, once the aliens Form I-140 petition has been approved, the alien beneficiary retains his or her priority date as established by the filing of the labor certification for any future Form I-140 petitions, unless the previously approved Form I-140 petition has been revoked because of fraud or willful misrepresentation. This includes cases where a change of employer has occurred; however, the new employer must obtain a new labor certification if the classification requested requires a labor certification (see the section on successor in interest).

I recently received an inquiry at my San Francisco immigration law office from an "employer" who recently discovered that a person whom he had hired as an independent contractor was in the United States illegally. The employer had not originally known that the "employee" was illegal because independent contractors are exempt from the requirements of the Immigration Reform and Control Act (*IRCA*) (https://www.oig.lsc.gov/legis/irca86.htm) that require an employer to verify that an an employee is authorized to work in the United States. The "employer" wanted to explore the options of legalizing the contractor. While thinking about the options, I became interested in how the law defines an independent contractor.
According to 8 Code of Federal Regulations Section 274a.1(j) (http://www.californiaimmigrationlawyerblog.com/8cfr274a.1.pdf) an independent contractor is an individual or entity who carries on an independent business, contracts to do a piece of work according to their own means and methods, and are subject to control only as to results.
The decision of whether or not someone is an independent contractor is determined on a case-by-case basis. Factors to be considered include whether the individual or entity:
supplies the tools or materials;
makes services available to the general public;
works for a number of clients at the same time;
has an opportunity for profit or loss as a result of labor or services provided;
invests in the facilities for work;
directs the order or sequence in which the work is to be done and determines the hours during which the work is to be done.
I began to wonder if people used independent contractors to get around the IRCA requirements. Apparently Congress thought about that as there is a regulation which states that an "employer" may not avoid the requirements of IRCA by hiring an independent contractor if a person or entity knowingly uses a contract or subcontract to obtain labor or services of an unauthorized alien. 8 C.F.R. 274a.5 (http://www.californiaimmigrationlawyerblog.com/8cfr274a.5.pdf).

Yes, this is very sad. I did receive the same email. Monthly $10 wouldn't be much. May be you can get rid of one pay channel or the munchies from grocery store. That's the only sacrifice you had to do !
It is really pity ! May be its fun to be on Illegal side:)

Thank you pal. Is it safe for her to apply for H4 while in India? or is better she apply after coming here? She wants to apply for H4 after coming to usa.
Applying for H4 while being in India might be the easiest. She can still continue her studies on H4, if she wants.

This shouldn't cause any problem... My GC was approved in August while i was in India. On my return two weeks after the approval, the officer allowed me in on AP. I showed him the printouts of my approval email and he said you can use your green card next time you go out of the country.
Hope you get your approval soon

Anoop - dont worry about it and ask your company to reapply with a stronger educational valuation. Everything depends on the educational valuation report submitted along with the application.
Request for a stronger educational evaluation and request them to reapply.

I don't know about legal risks but health-wise that sounds quite risky.
I can't believe to what extent some people will go to earn money!
Boss, don't make yourself a guinea pig. No amount of money is worth it.

Taught of debating if it is worth to live here more ??
Basically I came here to earn some money and to have some good life ( cleaning my bathroom myself -- lol )
The way things are going here in US with Jobs / Economy overall thinking if it is worth to live here and worth to get a US Passport or to keep renewing GC.
I know it all depends on each indivisual perspective and views.. but taught of looking other views on this.
Thanks and Regards -- Green_Always :-)

You have to withdraw old LC while filing the PERM hence prepartion can be parallel. It is better for you to file PERM ( you get it in 50 days or earlier) & get 140 ( 2 months after LC) & therefater apply for 3 years H! B extn.
You will not have to go through H1B circus, if you & others support IV & atleast generate $$ which is really driving our effort other than core members.
Best of luck

As far as I know, you should meet the requirements as of the priority date of the LC, not when the LC is switched. You may want to consult a good attorney on this one.

I and my wife are on EAD here and my wife had to go to India urgently on an Advance Parole that was expired last month. Can I apply for the AP renewal for her while she is in India, so that she can come back without any problems? Please let me know what options do I have. I am hoping that she would not be out of status or staying illegally here. Any answers would be very much appreciated. Thanks all.
Please tell me what options I have with me now.
