Hi, I am on At Will Employment, employer laid off on April 30 2009. I had seen in discussions, if employer laid off we an ask him for Return Flight Tickets. I need to confirm because i was on At Will Employment.

If you were on H1B
1. the employer has to provide you one way return ticket to your actual destination. this is the law.
If this can be done,
1. Tell your employer to give you one month vacation and keep you on the payroll. In that case, you can start applying for a job and if you get a job you should be saved. You would have to call employers rather than depending on rectruiters
2. If possible change to F1 visa,
3. Promptly apply for canadian immigration and move to canada, since you were in US in H1B there are high chances you would get a canadian PR within 6-8 months.
4. At least complete the FBI clearance when you are at US to apply for canadian PR.
5. Check for other oppurnities.
However,
1. Describe your skillset and the nature of work. Maybe someone from IV would help you.
2. Ask for help if you need something. Most of the IV members i got in touch are really helpful. In turn i have helped few of them.

1. Will not work as you are already out of status due to the denial
2. If the I-94 is valid till 11/9/2009 - Nov 9, 2009, If this I-94 is from the previous employer that already has revoked the H1b, it literally does not have any meaning as you are not maintaining your H1b with that employer or working for them.
3. Not even a possibility as H1b portability requires that you are currently in status.

My EAD expires on 07/28/2010. My EAD renewal is currently pending (applied online on 5/18/2010 at NSC). My AP expires on 08/24/2010. I am planning to apply for AP renewal once I finish my move to new address.
So, I really don't know which date to put. BTW, USCIS online application didn't mark that field as required.
Put the latest date ( AP ) . May be you can indicate that you are on AOS.

Federal Reserve Chairman Ben Bernanke said that on September 15, 2009, the worst recession since the 1930s is probably over, although he cautioned that pain - especially for the nearly 15 million unemployed Americans - will persist. I am a nurse from the Philippines currently living in northern California, enrolled in university, working towards my masters degree. I currently have a F1 student visa, have already passed the NCLEX and also hold a Philippines RN license. I don't have any work experience as a nurse besides my clinical experience as a student. I wanted to know what my current options are? I have a company willing to sponsor me on the east coast. I was referred to them by my sister-in-law who is currently working for them. I spoke to the companies recruiter but she couldn't answer some of my more detailed immigration questions.
I just wanted to get some options from some helpful members here. I currently have an appointment with an immigration lawyer next week but wanted to be somewhat inform on my options before meeting with the lawyer.
I know their is a long wait currently for nurses coming from the Philippines. Does it make my situation a little easier considering I am already in the US on a F1 visa? I was told that if they were to lift retrogression for nurses that I would be process asap because I am currently living in the US legally... I seriously have my doubts about this lol.
Any insight on my current situation is much appreciate.

A lot of nursing jobs dont need a 4 yr bachelor's degree and thats why you cant use
H1B for that unless the specialised nursing jobs needs a bachelors.
Therefore (thankfully) Nurses are directly applied for Green Card EB3. However there
is significant backlog even for ROW EB3. There is lobby effort to allocate green card quota for nurses like they did in 2004.
The employer (with the lawyer help) will file I140 for you and when the PD is current you can file I485.
But since you are on F1 visa, filing I140 you might have problem with the non immigrant intent clause at the
port of entry.

Based on my experience i do not see any issues in your case
Ensure your EB2 and EB3 job duties are different at least 50%
Apply for PERM ASAP as it is only 7 months now..
Porting is good and easy.. give it a try...

Guys,
It is always better to carry AP, in case if no AP, then No need to worry if it is a small duration since the GC is approved.
Even one can enter on valid H1 VISA when his/her own GC is approved as long as the duration between the GC approval and the date of Entry in USA is not too big. couple of weeks of duration is also fine.
I have confirmed this back in 2004 with couple of attorneys including Rajiv Khanna (ImmigationPortal.com).

Lost I20.
Went to school from 96 to 2000.
WOrking on H-1 since then.
Numerous trips outside. Last one in 2005 on an H-1 visa.
What do I do now?
That should not be any problem at all. I called my school's International office and they got my I20 from 99 scanned it and emailed it to me. I got it within half a day of making the call.

After filing 485, Is AC21 based changing employment is legal only when using EAD or it is applicable for H1-B transfer as well?
History - I filed my 485 in EB3 PD March 2004. Married after that, waiting to file my wife�s 485 for PD. Hence I am maintaining my H1 as well as H4 for my wife.

A corporate wide new policy at client location forces me to take full time or quit the job as not allowing a contract for more than two years continuously. I like to see what are the options legally can be possible without affecting my GC and legal residency of me and my wife.. I am now on my 11th year on H1 -B
Can I switch to new employer with a H1 transfer (not using EAD) using AC 21 where the 485 was filed by different employer. Is it possible / I mean using H1B to a new employer not EAD. And extending the H1-B continuously?
In case if I switch my job, and if the PD become current what are my options? Is my existing 485 application still valid? Can I file my wife�s 485 during the time.
Can I continue extending my H1-B based on my old I-485 EB3 with the new employer more than one time. assuming my PD may take more than another 3 yrs.

2) I-140 approved and my priority date is Aug 2006.
3) Company-B(end client) offered a full-time position starting Jan 2010.
What are my options? My questions are:

I know that it needs a crystal ball to predict such horrendun things like PD movement, but I am just trying to get a poll on the general feeling about the spillover this year.

You can check out the EB3-EB2 calculations thread. You have a decent chance of getting your GC by September 2011 based on the predictions there.
